Terms of Service
The short version: Use Numi responsibly and legally. Don't misuse it, reverse-engineer it, or rely on it for medical decisions. During the beta, things may break — that's expected. We appreciate your patience and feedback.
1. Acceptance of Terms
By downloading, installing, or using the Numi application ("App") or visiting this website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App or Site.
These Terms constitute a legally binding agreement between you and Numi ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Material changes will be communicated via email or an in-app notice. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
2. Eligibility
You must be at least 13 years old to use Numi. By using the App, you confirm that you meet this requirement. If you are between 13 and 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.
3. Beta Program
Numi is currently available as a pre-release beta through Apple TestFlight. By participating in the beta program, you acknowledge that:
- The App is in active development and may contain bugs, errors, or incomplete features.
- Features may change, be added, or be removed without notice.
- Your data may be reset or affected by updates during the beta period.
- Beta access is provided free of charge and does not guarantee a continued free tier after public launch.
- We may terminate your beta access at any time at our discretion.
Your feedback during the beta is invaluable. By submitting feedback, you grant us a royalty-free, worldwide license to use your suggestions to improve the product (without any obligation to do so or to compensate you).
4. License to Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on iOS devices that you own or control, solely for your personal, non-commercial use.
You may not:
- Copy, modify, or distribute the App or its content
- Reverse-engineer, decompile, or disassemble the App
- Use the App for any commercial purpose without our written consent
- Attempt to gain unauthorized access to our systems or networks
- Use the App in a way that violates any applicable law or regulation
- Scrape, crawl, or otherwise extract data from the App in bulk
5. Your Account
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@getnumi.app if you suspect unauthorized access to your account.
We reserve the right to terminate or suspend accounts that violate these Terms, engage in fraudulent activity, or are otherwise misused.
6. User-Generated Content
You retain ownership of any content you create within the App, including food photos and nutrition logs ("Your Content"). By using the App, you grant us a limited license to process Your Content solely as necessary to provide the App's features (for example, analyzing a food photo to return nutrition data).
You are responsible for ensuring that Your Content does not violate any third-party rights, applicable laws, or these Terms.
7. Health and Medical Disclaimer
Numi is a nutrition information tool, not a medical device. The nutrition data, insights, and recommendations provided by the App are for general informational purposes only.
Numi is not a substitute for professional medical advice, diagnosis, or treatment. Always seek the advice of your physician, registered dietitian, or other qualified health provider with any questions you have regarding a medical condition or dietary change. Never disregard professional medical advice or delay seeking it because of something you read or saw in Numi.
AI-generated nutrition estimates are approximations based on visual analysis and may not be fully accurate for all foods, preparation methods, or portion sizes.
8. Intellectual Property
All content, features, and functionality of the App — including but not limited to the interface design, graphics, text, AI models, and software — are the exclusive property of Numi and are protected by copyright, trademark, and other intellectual property laws.
"Numi" and the Numi logo are trademarks of Numi. You may not use our trademarks without our prior written permission.
9. Privacy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to our Privacy Policy.
10. Third-Party Services
The App integrates with third-party services including Apple HealthKit and AI APIs. Your use of those services is subject to their respective terms and policies. We are not responsible for the conduct of third-party services.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any nutrition information provided.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NUMI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE APP.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $100 USD.
13. Indemnification
You agree to indemnify and hold harmless Numi and its affiliates, officers, and employees from any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the App, violation of these Terms, or infringement of any third-party rights.
14. Termination
We may suspend or terminate your access to the App at any time, with or without cause or notice, if we believe you have violated these Terms or for any other reason at our sole discretion. Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.
15. Governing Law
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Numi operates, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in a court of competent jurisdiction.
16. Changes to Terms
We may revise these Terms at any time. When we do, we'll update the "Last updated" date at the top of this page and notify you through the App or by email if the changes are material. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
